These Conditions of Sale govern the telematic purchase of products and accessories made through the site www.carlopisellonio.com (hereinafter “the Site”). These conditions are formulated and provided in compliance with the provisions governed by Legislative Decree 09.04.2003 n. 70 as amended. , by Legislative Decree No. 206 of September 6, 2005 (Consumer Code) as amended and supplemented on the subject of distance selling to consumers as well as by European Community Directive 2003/31/EC implemented in Italy by Legislative Decree 70 of 2003 as amended and supplemented
The contract is concluded through the Internet network, by means of the Client’s or Professional’s access to the website with the sending of a purchase order according to the provided procedure and its subsequent acceptance by the Seller. The purchase order has the value of a contractual proposal and is governed by these general terms and conditions of sale, which the Customer is required to accept in full and without reservation, not before having carefully examined them.
The Customer who sends the order via the Internet through this site will receive, at the end of the procedure, a communication of confirmation from the order by electronic mail (email), indicating the relevant order number; in the event that, after sending the order, does not appear (after a few minutes) the order number, the proposal will be considered as not accepted, for all legal purposes, even if for accounting, administrative reasons or lack of product.
Within the e-shop, individual proposed products can be selected and reserved. It will be sufficient to indicate the quantity and confirm, subject to selection of any variants. In this way the products are placed inside the virtual shopping cart.
One can add, cancel or confirm all reservations made up to that moment.
In order to confirm the order, the Customer can proceed in these ways:
1. if already registered, via the e-mail address and password;
2. if not yet registered, by proceeding to registration, providing all the required data;
3. without registration, providing when requested the data necessary to finalize the purchase.
The purchase will be considered finalized only when the order is confirmed by e-mail by means of an “order confirmation” form. Confirmation is sent within a maximum of 2 working days after receipt of the order.
The unit selling price expressed in currency, including VAT and excluding shipping costs, is shown for each item.
The shipping fees may vary depending on the type of delivery, the quantity of products to be shipped, their volume, weight and place of destination; they will be highlighted during the purchase process and on the “VS order confirmation” form.
All products within the e-shop are printed on demand, so the average delivery time is _____. If unforeseen events occur due to delays in the delivery of products, the Customer will be promptly informed by e-mail, as well as in the case of even temporary unavailability of one or more products.
The Seller ships to all countries indicated during registration. However, there may be cases when customs issues prevent the delivery of the ordered products. In this case the Customer will be promptly informed by e-mail and reimbursed later.
Carlo Pisellonio accepts payments only through the systems listed below:
(a) PayPal
b) Credit card (American Express, Visa or Mastercard). The total amount of an order will be charged only when the products are actually shipped. This information is not stored and/or archived by Caffè Galliano.

Delivery of goods and shipping charges
All products ordered by the Customer and confirmed by the Seller, will be shipped by Courier to the address indicated by the Customer for delivery. Shipping costs are calculated at the time of payment of the order, depending on the country of destination of the order.
Products will be printed and shipped only after payment of the order amount has been duly registered and confirmed.
As products are printed at the Customer’s request, delivery time may vary.
Products sold are not subject to any import taxes or customs duties, if the product is sold and delivered in Italy or within the European Union.
In all cases, any costs related to import taxes and/or customs duties will be borne by the customer.
All products sold through the Site are custom-made for the customer, so ad nutum withdrawal (without justification) is not permitted.
The Seller shall be liable in case of wrong size, product that does not conform to the description or wrong size, in which case the provisions for the return of the item, with possible refund or replacement, set forth in Article 7 shall apply.
If the delivered product is found to be defective or damaged, the Customer shall notify the Seller as soon as possible and provide photographic evidence of the damage or defect, but no later than 14 days after receipt.
In the event that the package is visibly damaged, it will be necessary to proceed with acceptance subject to inspection directly at the time of delivery by the Carrier.
In the event of an incorrect, defective or damaged product, the Customer must still contact the Seller who will notify him/her of the instructions for delivering the package to the Carrier as well as provide him/her with the shipping label.
In the event of a return, the Seller reserves the right to inspect the product and photographic material submitted by the Customer before proceeding with the refund.
All contracts concluded shall be deemed to have been executed in Italy and shall be subject to the laws of Italy.
The Seller shall not be held liable if it fails to fulfill the order or is late in fulfilling it due to force majeure (by way of example, but not limited to, production blocks imposed by legislative or administrative measures, epidemics, strikes, severe weather events, fires, floods), even if such events prevent or delay the activity of the courier in charge of delivering the ordered product.
For the resolution of any disputes arising from the interpretation, execution and termination of the contract of sale at a distance, if the customer is a consumer (ie an individual who buys products not for purposes related to his professional activity) the territorial jurisdiction is of the court of the place of residence or domicile of the consumer, if located in Italy (Art. 63 Legislative Decree 205/2006, as amended).
If, on the other hand, the client is a professional (or any other entity or person who does not fall within the definition of consumer), the court of jurisdiction for dispute resolution is that of Treviso.
